{"id":3512,"date":"2024-07-15T12:28:00","date_gmt":"2024-07-15T10:28:00","guid":{"rendered":"https:\/\/www.studioprosdocimo.com\/it\/?p=3512"},"modified":"2024-07-16T12:28:37","modified_gmt":"2024-07-16T10:28:37","slug":"licenziamento-e-modalita-per-il-repechage","status":"publish","type":"post","link":"https:\/\/www.studioprosdocimo.com\/it\/licenziamento-e-modalita-per-il-repechage\/","title":{"rendered":"Licenziamento e modalit\u00e0 per il repechage"},"content":{"rendered":"\n<p><span style=\"color: #000000; font-family: times new roman, serif;\">Con ordinanza n.\u00a0<strong>18904\/2024<\/strong>, la Corte di Cassazione ha affermato la illegittimit\u00e0 del licenziamento per giustificato motivo oggettivo se l&#8217;imprenditore, dopo aver dichiarato la soppressione del posto di lavoro di natura impiegatizia, non ha offerto al lavoratore la ricollocazione in altre mansioni, anche di natura operaia e ovvero a termine, pur se tale decisione \u00e8 giunta dopo l&#8217;espletamento del tentativo obbligatorio di conciliazione ex art. 7 della legge n. 604\/1966 avanti alla commissione istituita presso l&#8217;Ispettorato territoriale del Lavoro.<\/span><\/p>\n<p><span style=\"color: #000000; font-family: times new roman, serif;\">Seguendo l&#8217;indirizzo gi\u00e0 espresso in passato, i giudici hanno stabilito che l&#8217;impossibilit\u00e0 della ricollocazione va provata al momento del recesso.
